Why we process your data
To arrange a divorce together with you, we need certain information. We only ask for what we actually use: for the conversations, for the documents you draw up together, for a possible application to the Legal Aid Board (Raad voor Rechtsbijstand) and for the administration surrounding all of this.
Which data we process
Your account and contact details. Your first name, email address, phone number and your preferred language.
Your official details. Your full name, date of birth, place of birth, nationality and address. We need these because they have to appear in the divorce documents.
Your citizen service number (BSN). Only if you apply for a contribution from the Legal Aid Board. The Board is legally obliged to ask for it. We store your citizen service number in encrypted form and it is only visible to the staff member handling your application. Every time someone views it, we record that.
Information about your children. Names, date of birth, where they live, school and what you agree together about their care. This information is needed for the parenting plan, which is legally required if you have underage children.
Your answers in the app. Everything you fill in about your home, possessions, debts, income, pension and the arrangements you make together. Together, these answers form your divorce settlement agreement and parenting plan.
Documents you upload. A copy of your proof of identity and any income details, if these are needed for the application to the Board. These files are stored securely and can only be accessed by the staff members handling your case.
Your personal notes. In the app you can make notes that are visible only to you. You decide for yourself whether you share them with the mediator.
Questions about how you are feeling. If you fill these in, we use your answers to tailor our guidance better to you. We only do this if you give your explicit consent, and you can withdraw that consent at any time.
Technical data. Whenever you agree to something important, we record when that happened, from which IP address and with which browser. We do this so that we can demonstrate later who agreed to what.
Why we are allowed to do this
- To perform the mediation agreement with you: your account, your case file, the documents and the conversations.
- Because the law requires it: your citizen service number for an application to the Legal Aid Board, and the data that has to appear in our administration.
- With your consent: the questions about how you are feeling, sharing your personal notes with the mediator, and receiving information by email. You can withdraw your consent at any time.
- Because we have a legitimate interest in it: handling a question you ask us before you become a client, and securing our app.
Who we share your data with
We never sell your data and we do not use it for other parties' advertising. To make the app work, we use a number of service providers. With each of them we have made agreements about the protection of your data.
- Supabase, for storing data and documents. The servers are located in Frankfurt, within the European Union.
- Netlify, for running the website itself.
- Brevo, for sending our email. Brevo is a French company.
- Signhost, for signing agreements digitally.
- CloudConvert, for converting your documents to PDF. We use their European servers.
In addition, we share data with parties involved in your divorce, and only in so far as this is necessary: the Legal Aid Board in the case of an application for a contribution, and the lawyer who files the petition with the court.
How long we keep your data
We keep your case file for as long as this is necessary for the divorce and for the period afterwards in which we still have to be able to account for it. Fixed periods apply to some data:
- Data we need in order to demonstrate how your case proceeded is kept for up to ten years after completion.
- We delete your citizen service number within twelve months after the application to the Legal Aid Board has been dealt with.
- We keep our technical logs for seven years.
Would you like us to delete your data sooner? Let us know. We will then look at whether that is possible and what we are legally required to keep, and we will tell you what we have done.
What we do not do
We do not measure what you do on our site using other parties' tracking software, and we do not place cookies to track you. Our emails sometimes contain a button or a link; if you click on it, we only count *that* a click took place. We do not record an IP address or build a profile.
We do not make decisions about you that are reached in a fully automated way. The check in the app that indicates whether you are likely to qualify for a contribution is an estimate. The Legal Aid Board makes its own decision, and a person is always involved.
Your rights
You may ask us to give you access to your data, to correct it, to delete it or to restrict its use. You may also ask to receive your data in a readable file, and you may object to certain processing. If you have given consent, you can withdraw it at any time.
Please note: some data appears in documents that you drew up and signed together. We cannot simply change these, because they also concern your ex-partner and because they have legal significance. In that case, please contact us and we will work out together what is possible.
Send your request to info@oprechtscheiden.nl. We will respond within one month.
If you are not satisfied with the way we handle your data, we would like to hear about it from you first. You also always have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
Security
Your data is stored in encrypted form and can only be accessed by the staff members working on your case. Your citizen service number and your proof of identity are given extra protection: only those who really need them can access them, and every viewing is recorded.
Changes
If something changes about the app or about the way we handle data, we will update this statement. At the top of the page you can see when the text was last changed.
